On Tuesday, August 24, news surfaced that the baby from Nirvana’s Nevermind album cover is suing the band. Spencer Elden, who is no longer a baby, filed a suit in a Los Angeles court claiming the image has caused him ‘lifelong damages.’

Predictably, the band’s fans did not see this coming!

Nevermind was Nirvana’s second studio album which was released on September 24, 1991. Ever since the news about the lawsuit broke, many fans have taken to Twitter to express their thoughts on the issue.

Nevermind album’s cover star, Spencer, is a 30-year-old man now. Many Nirvana fans may not know that he was only four months old when the cover was shot.

Spencer has an Instagram account with 4,400 followers, but he is not active on the platform now. He has posted only three pictures so far, and his last post on the account came in 2016.

However, what may surprise many fans when they first land on Spencer’s account, is the fact that in one of his posts from 2015, he is seen posing with the Nevermind album cover, the same one he is suing now.

Although he isn’t very active on Facebook either, from his profile on the platform, we know that Spencer is an artist by profession. He has created many impressive pieces over the years, with some retailing at over $100.

Spencer is now an artist living in LA.

His parents were paid £154 for the original shoot and he was paid the same amount earlier this month for the recreation.

The original photo was taken by Kirk Weddle, a friend of Spencer's dad.

The new picture is taken by British photographer John Chapple in the same California pool as the original.

It's not the first time Spencer has been asked to recreate the image - he has posed three times before for the album's 10th, 17th and 20th anniversaries.

But he's never actually met the two surviving members of Nirvana.

Nevermind was Nirvana's most successful album, selling more than 30 million copies.

It produced hits like Smells Like Teen Spirit and Come As You Are.

At the time, Elden’s father helped with sets, custom rigging and props for photo shoots, which is how he got to know Weddle.

When he is older, Spencer Elden has recreated the photo shoot a number of times and has a large tattoo that says “Nevermind” on his chest, he says he hasn’t fully come to terms with being on the album’s cover, 20 plus years late, so we wonder.. will he ever? “I got a little upset for a bit,” he says. “I was trying to reach out to these people. I never met anybody. I didn’t get a call or email. I just woke up already being a part of this huge project. It’s pretty difficult—you feel like you’re famous for nothing, but you didn’t really do anything but their album.”

Spencer Elden is the son of Rick Elden. His father was a friend of Weddle who was part of Nirvana. His father, Rick was offered $200 for the photoshoot which he mentions ended very quickly too and was done during a pool party. After the success of the album, his family was also sent a platinum copy of Nevermind along with a teddy bear. Spencer Elden was still an infant during this shoot.

Elden mentions that he grew up as a normal teen who graduated from a Los Angeles-based high school. Mentioning his childhood, Elden said that he spent a lot of time drawing.

Spencer Elden was the man whose picture as a naked baby was used on the cover of the multimillion-selling Nirvana album “Nevermind” filed suit Tuesday in Los Angeles, alleging the former members of the grunge-rock trio, various record companies, art directors and others violated federal criminal child pornography laws and caused him lifelong suffering by “trafficking” his image worldwide.

Spencer Elden said that his “identity and legal name are forever tied to that picture. He experienced as a minor which has been distributed and sold worldwide from the time he was a baby to the present day,” according to the complaint filed in Los Angeles federal court.
